IoT Analytics, its subsidiaries and partner companies (hereinafter referred to jointly and singly as “IoT Analytics”) consider the protection of your personal data and your right of informational self-determination to be of great importance. IoT Analytics will collect, process and use the personal data that it collects in the course of your visit to its website and its integrated online store as well as any external website that IoT Analytics has created for any interested party e.g., webinar landing pages (hereinafter referred to jointly and singly as the “Website”). In doing so it will comply with the principles described below as well as with the provisions of the Federal Data Protection Act (Bundesdatenschutzgesetz) and those of the Telemedia Act (Telemediengesetz).

1. Your personal data

Personal data consists of information regarding personal or factual circumstances which could be used to establish a link to your person. Such data includes, for example, your name, your telephone number as well as your postal and e-mail addresses.

2. Collection and use of your personal data

When you visit the IoT Analytics Website, your personal data will only be collected and used if you register at the Website or if your visit culminates in the conclusion of a contract. If you do not register during your visit or conclude a contract at our Website, no personal data will be collected or used.

While visiting our Website, you will be requested to supply personal data at various times. We collect and use this data

  • to create a customer account for you / MyAccount,
  • to take and process your order,
  • to collect outstanding receivables,
  • to receive and process your enquiries,
  • to perform a credit check where we have a justified interest in same,
  • and, if you have granted your consent separately, also to send you newsletters.

a) Information regarding the use of your personal data to create your customer account / MyAccount
IoT Analytics will use the personal data that you enter while registering at its Website. It will, in particular, use your name (first name and surname), address, telephone number, e-mail address and your birthday to make shopping at its store as convenient and easy as possible. Its use of this information will be limited to that which is necessary to conclude a contract with you or define or amend the terms of same.

b) Information about the use of your personal data to accept and process an order
IoT Analytics will use the personal data that you enter while making a purchase at our Website, in particular your name (first name and surname), address, telephone number, e-mail address, your credit card number, date of birth and bank details to the extent that this is necessary for the processing and invoicing of your order.

IoT Analytics may pass on your personal data to a logistics company of its choice to arrange for the delivery of your order. The logistics company will process this data on behalf of IoT Analytics and in compliance with this Data Protection Policy and will take the necessary security measures.

c) Information regarding the use of your personal data to collect outstanding receivables
IoT Analytics will also use the personal data that it has collected and saved while accepting and processing your order in order to collect any outstanding receivables. In such cases, we engage a collection agency and supply it with the necessary data. The collection agency will process this data in compliance with this Data Protection Policy and will take the necessary security measures.

d) Information about the use of your personal data to process your enquiries
IoT Analytics also collects and uses your personal data when handling suggestions and comments that you submit on a contact form at its Website.

e) SCHUFA or InfoScore Consumer Data credit checks
IoT Analytics will pass on certain information that you have supplied in the course of placing an order to carefully selected service providers which will then check your credit standing. We supply such firms with the following information: your first name and surname, your postal address and your date of birth. The service provider will check your credit standing for any negative items and will determine your credit score. This credit score is based on a statistical calculation of the risk of default. It takes into account recognized empirical values that include, among other things, data related to your postal address. These service providers currently include SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden, InfoScore Consumer Data GmbH, Rheinstrasse 99, 76532 Baden-Baden and Informa Unternehmensberatung GmbH, Rheinstrasse 99, 76532 Baden-Baden.

IoT Analytics will, in any case, comply with the relevant statutory provisions and will also pass on personal data relating to receivables to SCHUFA and InfoScore Consumer Data, if so requested. This also applies to the disclosure of any personal data regarding contractual violations if this is permissible following a weighing of all of the interests concerned. SCHUFA and InfoScore Consumer Data store this data and pass it on to their partners in the EU countries so that this information can be used in assessing the creditworthiness of individuals. Upon request, SCHUFA and InfoScore Consumer Data will inform you as to the information they have stored about you. g) Use of your personal data for sending you newsletters
If you expressly consent, IoT Analytics will use your personal data, in particular your name (first name and surname), your address, your telephone number, your e-mail address, your birthday, your interests so that it can continue sending you personalized updates on new developments at no obligation. Furthermore, IoT Analytics will also use your data to provide you with additional information about its products and special offerings, such as birthday greetings or customer questionnaires and general customer information. Communication can be by electronic means (e-mail or text message) or using the postal service.

For sending newsletters IoT Analytics will avail itself of specialized service providers to which it will pass the necessary personal data. These service providers will only use your personal data on behalf of IoT Analytics and only in accordance with its instructions. Compliance with these data protection provisions is ensured as are the necessary security measures.

h) Use of your personal data when working with affiliated partners
In specific situations, IoT Analytics may work with a partner that gets access to selected personal data. IoT Analytics only shares personal data with their partners if explicit consent has been given that a partner may reach out. Once such a consent has been provided, IoT Analytics may share selected personal data with that partner who then may reach out to a given email address or phone number.

3. Cookies and automatically collected technical information

The IoT Analytics Website also uses what are known as cookies. Cookies are small text files which are stored by your browser on your hard disc. We use the information in the cookies to make your online visit more pleasant and more personal and, for example, to manage your virtual shopping cart. In addition, we use cookies to save your individual settings, such as your language selection, so that you do not have to change the settings each time you go online. We save the following data in encrypted form in the cookies we use: an anonymous ID for your computer and the settings that you have made at our Website.

Furthermore, we use various other automatically transferred technical information, such as your IP address. Your IP address will only be saved as user-specific data in connection with a payment – to protect against fraud – and will be deleted no later than six months after collection or after the relevant statutory retention period.

4. Grant and revocation of your consent

IoT Analytics will request your express consent before using your personal data to send you newsletters. 5. Length of time that your personal data will be stored and disclosure, updating and deletion of this data

As a matter of principle, IoT Analytics will not store your data any longer than necessary for the purposes stated in these data protection provisions or to comply with any relevant statutory duty to archive or otherwise keep records. Upon your request and at no charge to you, IoT Analytics will disclose to you the data it has stored regarding your person, the use of this data and the related processing.
